Illinois Energy Conservation Code

Illinois Governor Rod Blagojevich signed the new Illinois Energy Conservation Code into law in August 2004 with Public Act 093-0936. This new Law requires all new commercial construction for which a building permit application is received by a municipality or county to follow a comprehensive statewide energy conservation code. Renovations, alterations, additions and repairs to most existing commercial buildings must follow the Illinois Energy Conservation Code. Local governments are also free to adopt stricter energy conservation laws.
Provisions of this statewide commercial energy conservation code became effective April 8, 2006.
Illinois' Energy Efficient Commercial Building Act can be found in Chapter 20 of the Illinois Compiled Statutes, Act 3125. The law went into effect under rulemaking titled "Illinois Energy Conservation Code" (71 Ill Adm Code 600; 29 Ill Reg 4771).
Specifically, the Law requires the Capital Development Board of Illinois (CDB) to adopt the 2000 International Energy Conservation Code (IECC) with a 2001 Supplement. Chapter 8 of the IECC deals with building design for commercial buildings. This chapter also references ASHRAE 90.1, 1999 as an acceptable alternative to demonstrate compliance.
Commercial building professionals may comply with the Illinois Energy Conservation Code by submitting the compliance forms published in the ASHRAE 90.1 User Manual, or by submitting Compliance Certificates generated by the U.S. Department of Energy's COMcheck computer software program. The local authority having jurisdiction may require additional means of compliance.
